Statement on the letter to the Archivist

The ERA Coalition vigorously opposes the demand by U.S. Senators Romney (Utah), Portman (Ohio), and Johnson (Wisconsin) sent to the Archivist of the United States dated February 8, 2022. In their letter, mentioning the Coalition, they insist that the Archivist not publish the ERA. 

We are demanding just the opposite: the Archivist should publish the ERA immediately.

The ERA Coalition remains firm in its conviction that the Equal Rights Amendment has met the requirements set out in Article V of the Constitution: passage by two thirds of Congress and ratification by 38 states. It became effective on January 27, 2022 at the end of the two year waiting period after ratification of the 38th state, Virginia.

The time limit imposed on the amendment is invalid — it was inserted in the introductory clause, not the amendment itself, and not voted on by any state.

We are insisting on recognition of the ERA by the Archivist of the United States, which means publication in the Constitution so that it reflects all 28 Amendments.
